Level 9 Work-Related Injury Compensation in China
According to the Chinese Labor Law, work-related injuries are classified into 10 levels, with Level 9 being the least severe. The employer is responsible for all reasonable medical expenses incurred as a result of the work-related injury. This includes expenses for hospitalization, surgery, medication, and rehabilitation. The employer must also provide transportation to and from medical appointments.
Temporary Disability Allowance:
If the victim is unable to work due to the injury, they are entitled to a temporary disability allowance. The allowance is calculated as a percentage of the victim's average monthly salary, based on the duration of the disability. For a Level 9 injury, the allowance is typically paid for up to 12 months.
Permanent Disability Allowance:
If the injury results in permanent disability, the victim is entitled to a permanent disability allowance. The allowance is calculated based on the severity of the disability and the victim's age. For a Level 9 injury, the allowance is typically paid for up to 24 months.
Vocational Rehabilitation Costs:
If the injury prevents the victim from returning to their previous job, the employer is responsible for providing vocational rehabilitation to help them acquire new skills and find a suitable alternative employment.
Other Compensation:
In addition to the above, the victim may also be entitled to compensation for pain and suffering, mental anguish, and loss of earning capacity. The amount of compensation is determined on a case-by-case basis.
Calculation of Total Compensation:
The total compensation for a Level 9 work-related injury is calculated as follows:
Medical expenses + Temporary disability allowance + Permanent disability allowance + Vocational rehabilitation costs + Other compensation
Example:
If a victim with an average monthly salary of 5,000 RMB sustains a Level 9 work-related injury that results in a 10% permanent disability, the total compensation may be calculated as follows:
Medical expenses: 5,000 RMB Temporary disability allowance (6 months): 5,000 x 6 x 60% = 18,000 RMB Permanent disability allowance (12 months): 5,000 x 12 x 10% = 6,000 RMB Vocational rehabilitation costs: 2,000 RMB Other compensation: 3,000 RMB
Total Compensation: 34,000 RMB
